Terms & Conditions

These terms govern use of the MYVU platform, the MYVU mobile app, and the detection software supplied for on-site hardware.

1. Who these terms are with

MYVU is provided by MYDIS(“we”). They apply to the organisation that subscribes (the “Customer”) and to each person the Customer invites to use it (“you”). Where a signed agreement exists between MYDIS and the Customer, that agreement takes precedence over these terms wherever the two conflict.

2. What MYVU is not

MYVU is a monitoring aid. It is not a life-safety system, a medical device, an alarm-receiving centre, or a substitute for supervision, site safety procedures, or emergency services.

  • Detection is probabilistic. It will sometimes miss an event, and it will sometimes raise one that did not happen.
  • Alerts depend on cameras, on-site power, network connectivity, the notification services operated by Apple and Google, and the recipient’s own device and settings. Any of these can fail or delay a notification.
  • Nobody should be left to work alone in reliance on MYVU raising an alarm if they are hurt. It is an additional pair of eyes, not the only pair.

The Customer remains responsible for health and safety, for staffing, and for its own emergency procedures.

3. Accounts

  • Accounts are personal. Do not share credentials — audit records attribute every acknowledgement and setting change to an account.
  • Keep your credentials secure and tell us promptly if you believe an account has been compromised.
  • The Customer decides who is invited, what role they hold, and which sites they may see, and is responsible for removing people who leave.

4. The Customer’s responsibilities for monitoring

Cameras record people. Before deploying MYVU, and continuously afterwards, the Customer is responsible for:

  • Having a lawful basis for workplace monitoring in its jurisdiction.
  • Informing workers and visitors that cameras are in use, including signage and any consultation required by law.
  • Completing a Data Protection Impact Assessment where one is required.
  • Positioning cameras appropriately, and not in places where people are entitled to privacy.
  • Responding to requests from individuals about footage, for which the Customer is the data controller.

The Customer will not use MYVU to identify individuals biometrically, to track individual productivity covertly, or for any purpose unlawful in its jurisdiction.

5. Acceptable use

You may not:

  • Attempt to access data belonging to another organisation, or probe, scan or test the security of the platform without written permission.
  • Reverse engineer, decompile or attempt to extract the detection models, except where that right cannot lawfully be excluded.
  • Resell, sublicense or provide the service to a third party without our written agreement.
  • Interfere with the service, or use it in a way that degrades it for others.

6. On-site hardware and software

  • Detection software supplied for on-site hardware is licensed, not sold, for the term of the subscription and for use at the sites agreed.
  • The Customer provides suitable power, network connectivity and a physically secure location, and provides safe access for commissioning and maintenance.
  • We may update the detection software remotely, including changes that alter detection behaviour. Where an update materially changes behaviour we will give reasonable notice.

7. Availability

We aim to keep MYVU available continuously but do not guarantee uninterrupted service. Maintenance, provider outages, connectivity loss at the site and events outside our control can interrupt it. Where a written service level has been agreed with the Customer, that agreement governs.

8. Data

Personal data is handled as described in our Privacy Policy. Between us and the Customer, the Customer owns its footage, detection records and configuration. On termination the Customer may request an export within 30 days, after which we may delete it.

We may use aggregated, de-identified statistics — figures that identify neither a person nor a customer — to improve detection accuracy and the product.

9. Fees

Fees, billing period and term are as set out in the Customer’s order or agreement. Fees are exclusive of VAT and other taxes unless stated. We may suspend the service for accounts materially overdue, after notice.

10. Intellectual property

MYVU, its software, models, interfaces and branding remain the property of MYDIS. Nothing in these terms transfers ownership. Feedback you give us may be used without obligation or restriction.

11. Warranties and liability

The service is provided with reasonable skill and care. Beyond that, and to the extent the law allows, it is provided “as is” without further warranty, including any warranty that detection will be complete or accurate.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, and to the extent permitted by law:

  • Neither party is liable for indirect or consequential loss, loss of profit, loss of production, or loss of livestock.
  • Our total liability in any twelve-month period is limited to the fees paid by the Customer for the service in that period.

12. Suspension and termination

Either party may terminate as set out in the Customer’s agreement. We may suspend access immediately where use threatens the security or integrity of the platform, or where required by law, and will tell the Customer why.

13. Changes to these terms

We may update these terms. Where a change materially affects the Customer’s rights we will give reasonable notice by email or in the platform. Continued use after a change takes effect is acceptance of it.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting any mandatory rights you have in your country of residence.
